Based on expert reports pointing to a marked contamination of Lagoa Mundaú, the Federal Public Ministry (MPF) in Alagoas officiated several public entities, in order to request information on possible measures that are being adopted in view of the worrying situation of the Lagunar Estuary under the from an environmental and public health point of view for the population of Maceió and the State of Alagoas.

Among the official entities are: Federal Police Superintendence in Alagoas, National Water and Sanitation Agency (ANA), State Secretariat for the Environment and Water Resources of Alagoas (Semarh), state deputy Cabo Bebeto and Fundação de Amparo à Pesquisa of the State of Alagoas (Fapeal).

The letters authored by the Attorney General Juliana Câmara, holder of the 9th Office for the Environment, were issued within the scope of IC nº, established to investigate, from a structural perspective, the multiple causes of degradation of the Complex Estuarino Lagunar Mundaú-Manguaba (CELMM), with the objective of enabling the elaboration, implementation and monitoring of an action plan to guarantee the ecological integrity of the lagoon ecosystem through socio-ecological governance.


By means of a letter to the Federal Police, the MPF requests the initiation of a police investigation to investigate the authorship of the environmental crime that generated a large volume of dead fish in Lagoa Mundaú, Flexal de Baixo region, in the neighborhood of Bebedouro, on the 13th of March 2022.

From ANA, the MPF requests information, within 15 days, on the current stage of implementation of the Action Plan and Integrated Management of the Mundaú-Manguaba CELMM Estuarine Lagoon Complex, forwarding the respective documentation proving the actions already taken.

Information was also requested on the current composition of the Basin Committee of the CELMM Hydrographic Region and what actions have been carried out since 2006 (date of its creation) and what measures are in progress aimed at preserving the Mundaú and Manguaba lagoons. Semarh was also given a period of 15 days.

Information published in the press highlights the allocation of an amendment by state parliamentarian Cabo Bebeto to a project to enable the analysis and monitoring of the CELMM, so the MPF asks the state deputy for detailed information about the aforementioned project by FAPEAL, UFAL and UNCISAL.

Finally, Fapeal itself was asked for information about the existence of any study or project aimed at recovering the CELMM, forwarding the documentation, if so. Fapeal and the parliamentarian were given the same 15-day deadlines.

Investigation – The investigation undertaken by the MPF brought together technical and expert reports presented by the Federal University of Alagoas (UFAL) and by the Institute of the Environment in Alagoas (IMA/AL).

UFAL, through studies coordinated by Professor Emerson Soares, concluded that more than one chemical compound contributed to fish mortality in the Flexal de Baixo region, in Bebedouro, on 03/13/2022.

The first item in Professor Emerson’s report highlights that “the fish died from chemical and organic poisoning, due to the product being released, whether it was intentional, by escape or by surface runoff (leaching). This acts to increase the cellular permeability, allowing the entry of undesirable ions into the cells and preventing the gas exchange of the gills with the aquatic environment, in this way the specimens with little energy and swimming capacity did not have the opportunity to move from the contaminated area taking them to the water. them to death”.

Finally, suggesting the monitoring of the lagoon environment with a view to public health and food quality and safety, due to some high levels of mercury, manganese, potassium, BTEX (toluene), bacteria and fecal coliforms found in the environment. These affect and can bring serious damage to the health of the population.

The IMA/AL analyzes showed that the physical-chemical parameters were not adequate to the maximum limits required by the legislation regarding the parameters: total phosphorus, oils and greases, turbidity and thermotolerant coliforms.

For the prosecutor of the Republic Juliana Câmara, “the panorama revealed by the expert reports – in addition to what happened in March – reveals a worrying situation from an environmental and public health point of view. It is a complex problem, repeated over time and multi-causal”.

Joint action – The Attorney General’s Office (PGR) was also asked to appoint the Attorney General Lucas Horta, holder of the 4th Office of the Environment, to act jointly, considering that the seriousness and complexity of the case require priority and institutionalized action. by the MPF.
